Smile Divorce & Spanish property

Hi,
I know a couple who are getting divorced. They own a property in Spain and currently live in the UK. The property is in both their names. The husband is playing games and trying to hide his money so as not to have to share it with his wife. So my question is, willl he be able to sell the property even though its in both names? I know in theory probably not, but would this sort of thing be easier to get away with in Spain? Any advice would be welcome, as this is obviously a worryying situation for those involved.

Default both owners need to be there

Hello

i am pretty sure that both owners of the property need to be at the notary to sign over the deeds to the new owners so unless he has power of attorney or the house is only in his name i can't see how he will be able to sell the property without the signatures of both owners on the deed

if the person in question wants to check this would be very easy just a call to a Gestor or a notary office and they ill answer your questions

You are completely right Dave, both of the names on the title deeds of the property must attend to sign or have power of attorney signed over to the legal company that they are both using to be able to sell the property otherwise it would not be able to be sold.
